73. Statistics are covered by the Freedom of Information Acts. In meeting the requirements of the Freedom of Information (Scotland) Act 2002 the Scottish Government has issued guidance on specific issues that arise in relation to statistics. This is published at http://www.scotland.gov.uk/Topics/Statistics/scotstat/foi-guidance

74. Key points are

(a) Obligations under the National Statistics Code in terms of openness and provision of information are additional to FoI requirements.

(b) In meeting FoI requirements we will maintain our interest in ensuring that statistics are accurate, fit for purpose and are not misused or disclosive, although none of that changes the rights of access to information under FoI.

(c) As a general principle exemptions will not be applied where the information would not normally be refused under the National Statistics Code of Practice.

(d) Even where the request is refused on the basis of particular exemption the applicant will be informed

  • when any statistics sought will be available
  • of any next best alternatives. This may be published information.

(e) Staff should continue to follow best practice in terms of ensuring that the information request is clear and that any data requested will meet the applicant's needs.
