is established a body to be known as Creative Scotland or Alba Chruthachail.</p></content></subsection><subsection eId="section-36-2"><num>2</num><content><p>Schedule 9 (which makes further provision about the status, constitution, proceedings <abbr title="et cetera" xml:lang="la">etc.</abbr> of Creative Scotland) has effect.</p></content></subsection></section><section eId="section-37" period="#period1"><num><noteRef href="#key-5968961fd51035e416ef5ff7fbf79b2e" marker="I2" class="commentary I"/>37</num><heading>General functions of Creative Scotland</heading><subsection eId="section-37-1"><num>1</num><intro><p>Creative Scotland has the general functions of—</p></intro><paragraph eId="section-37-1-a"><num>a</num><content><p>identifying, supporting and developing quality and excellence in the arts and culture from those engaged in artistic and other creative endeavours,</p></content></paragraph><paragraph eId="section-37-1-b"><num>b</num><content><p>promoting understanding, appreciation and enjoyment of the arts and culture,</p></content></paragraph><paragraph eId="section-37-1-c"><num>c</num><content><p>encouraging as many people as possible to access and participate in the arts and culture,</p></content></paragraph><paragraph eId="section-37-1-d"><num>d</num><content><p>realising, as far as reasonably practicable to do so, the value and benefits (in particular, the national and international value and benefits) of the arts and culture,</p></content></paragraph><paragraph eId="section-37-1-e"><num>e</num><content><p>encouraging and supporting artistic and other creative endeavours which contribute to an understanding of Scotland's national culture in its broad sense as a way of life,</p></content></paragraph><paragraph eId="section-37-1-f"><num>f</num><content><p>promoting and supporting industries and other commercial activity the primary focus of which is the application of creative skills.</p></content></paragraph></subsection><subsection eId="section-37-2"><num>2</num><content><p>In exercising the function mentioned in subsection (1)(c), Creative Scotland must do so with a view to increasing the diversity of people who access and participate in the arts and culture.</p></content></subsection><subsection eId="section-37-3"><num>3</num><content><p>Creative Scotland may encourage and support such persons as it considers appropriate in the exercise by those persons of any of the functions mentioned in paragraphs (a) to (f) of subsection (1) (or functions similar to those).</p></content></subsection><subsection eId="section-37-4"><num>4</num><content><p>In subsection (3),  “<term refersTo="#term-persons">persons</term>” includes groups of persons.</p></content></subsection></section><section eId="section-38" period="#period1"><num><noteRef href="#key-42af19548366fc0ea56d574745b14717" marker="I3" class="commentary I"/>38</num><heading>Advisory and other functions</heading><subsection eId="section-38-1"><num>1</num><intro><p>Creative Scotland must provide the Scottish Ministers with such advice, information and assistance as they may reasonably require in relation to—</p></intro><paragraph eId="section-38-1-a"><num>a</num><content><p>the arts and culture,</p></content></paragraph><paragraph eId="section-38-1-b"><num>b</num><content><p>industries and other commercial activity the primary focus of which is the application of creative skills,</p></content></paragraph><paragraph eId="section-38-1-c"><num>c</num><content><p>the exercise of any of Creative Scotland's functions.</p></content></paragraph></subsection><subsection eId="section-38-2"><num>2</num><content><p>Creative Scotland may provide the Scottish Ministers with such other advice and information as it considers appropriate in relation to the matters mentioned in subsection (1)(a), (b) and (c).</p></content></subsection><subsection eId="section-38-3"><num>3</num><intro><p>Creative Scotland may provide such other persons as it considers appropriate with such advice, information and assistance as it considers appropriate in relation to—</p></intro><paragraph eId="section-38-3-a"><num>a</num><content><p>the arts and culture,</p></content></paragraph><paragraph eId="section-38-3-b"><num>b</num><content><p>industries and other commercial activity the primary focus of which is the application of creative skills.</p></content></paragraph></subsection><subsection eId="section-38-4"><num>4</num><content><p>Any advice, information or assistance under subsection (1) or (2) must be provided in such manner as the Scottish Ministers may determine.</p></content></subsection><subsection eId="section-38-5"><num>5</num><content><p>In this section,  “<term refersTo="#term-assistance">assistance</term>” does not include financial assistance.</p></content></subsection><subsection eId="section-38-6"><num>6</num><content><p>In subsection (3),  “<term refersTo="#term-persons">persons</term>” includes groups of persons.</p></content></subsection></section><section eId="section-39" period="#period1"><num><noteRef href="#key-06b1f4dc525faa9ab8284eacd78c741b" marker="I4" class="commentary I"/>39</num><heading>Grants and loans</heading><subsection eId="section-39-1"><num>1</num><content><p>The Scottish Ministers may make grants to Creative Scotland.</p></content></subsection><subsection eId="section-39-2"><num>2</num><content><p>In addition to any grants made under subsection (1), the Scottish Ministers may make grants to Creative Scotland for particular purposes.</p></content></subsection><subsection eId="section-39-3"><num>3</num><content><p>A grant under subsection (1) or (2) is subject to such terms and conditions (including conditions as to repayment) as the Scottish Ministers may determine.</p></content></subsection><subsection eId="section-39-4"><num>4</num><content><p>Creative Scotland may make grants and loans to such persons as it considers appropriate for the purpose of, in connection with, or where it appears conducive to, the exercise of its functions.</p></content></subsection><subsection eId="section-39-5"><num>5</num><content><p>A grant or loan under subsection (4) is subject to such terms and conditions (including conditions as to repayment) as Creative Scotland may determine.</p></content></subsection></section><section eId="section-40" period="#period1"><num><noteRef href="#key-072caad097309c53804f72ec03012c25" marker="I5" class="commentary I"/>40</num><heading>Directions and guidance</heading><subsection eId="section-40-1"><num>1</num><content><p>The Scottish Ministers may give Creative Scotland directions (of a general or specific nature) as to the exercise of its functions.</p></content></subsection><subsection eId="section-40-2"><num>2</num><content><p>But the Scottish Ministers may not give directions so far as relating to artistic or cultural judgement in respect of the exercise of Creative Scotland's functions under section 37(1) or (3), 38(3) or 39(4).</p></content></subsection><subsection eId="section-40-3"><num>3</num><intro><p>Creative Scotland must—</p></intro><paragraph eId="section-40-3-a"><num>a</num><content><p>comply with any directions given to it by the Scottish Ministers under this Part,</p></content></paragraph><paragraph eId="section-40-3-b"><num>b</num><content><p>have regard to any guidance issued by the Scottish Ministers in relation to the exercise of its functions.</p></content></paragraph></subsection><subsection eId="section-40-4"><num>4</num><content><p>Subject to subsection (2), the Scottish Ministers may vary or revoke any direction given under this Part.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" eId="part-4-crossheading-miscellaneous-and-general" period="#period1"><heading><i>Miscellaneous and general</i></heading><section eId="section-41" period="#period1"><num><noteRef href="#key-6ab1baafab714dc832397efc5852c7c4" marker="I6" class="commentary I"/>41</num><heading>Dissolution of Scottish Arts Council</heading><subsection eId="section-41-1"><num>1</num><content><p>The Scottish Arts Council is dissolved and the charter constituting that body is revoked.</p></content></subsection><subsection eId="section-41-2"><num>2</num><content><p>In subsection (1), the  “charter” is the Royal Charter granted by Her Majesty on 8 February 1994.</p></content></subsection></section><section eId="section-42" period="#period1"><num><noteRef href="#key-9ae2e8a98ddc7113cbd2854f57e40817" marker="I7" class="commentary I"/>42</num><heading>Transfer of staff <abbr title="et cetera" xml:lang="la">etc.</abbr></heading><subsection eId="section-42-1"><num>1</num><intro><p>With effect from the date on which section 41 comes into force—</p></intro><paragraph eId="section-42-1-a"><num>a</num><intro><p>any person employed by—</p></intro><subparagraph eId="section-42-1-a-i"><num>i</num><content><p>the Scottish Arts Council immediately before that date, or</p></content></subparagraph><subparagraph eId="section-42-1-a-ii"><num>ii</num><content><p>Scottish Screen immediately before that date,</p></content></subparagraph><wrapUp><p>is transferred into the employment of Creative Scotland,</p></wrapUp></paragraph><paragraph eId="section-42-1-b"><num>b</num><intro><p>all property (including rights) and liabilities of—</p></intro><subparagraph eId="section-42-1-b-i"><num>i</num><content><p>the Scottish Arts Council subsisting immediately before that date,</p></content></subparagraph><subparagraph eId="section-42-1-b-ii"><num>ii</num><content><p>Scottish Screen subsisting immediately before that date,</p></content></subparagraph><wrapUp><p>are transferred to, and vest in, Creative Scotland.</p></wrapUp></paragraph></subsection><subsection eId="section-42-2"><num>2</num><intro><p>The contract of employment of a person transferred by virtue of subsection (1)(a)—</p></intro><paragraph eId="section-42-2-a"><num>a</num><content><p>is not terminated by the transfer, and</p></content></paragraph><paragraph eId="section-42-2-b"><num>b</num><content><p>has effect from the date of transfer as if originally made between the person and Creative Scotland.</p></content></paragraph></subsection><subsection eId="section-42-3"><num>3</num><intro><p>Without prejudice to subsection (2), where a person is transferred by virtue of subsection (1)(a)—</p></intro><paragraph eId="section-42-3-a"><num>a</num><content><p>all the rights, powers, duties and liabilities of the Scottish Arts Council or, as the case may be, Scottish Screen, under or in connection with the person's contract of employment are transferred to Creative Scotland on the date of transfer, and</p></content></paragraph><paragraph eId="section-42-3-b"><num>b</num><content><p>anything done before that date by or in relation to the Scottish Arts Council or, as the case may be, Scottish Screen, in respect of the person or the contract is to be treated from that date as having been done by or in relation to Creative Scotland.</p></content></paragraph></subsection><subsection eId="section-42-4"><num>4</num><content><p>Subsections (1) to (3) do not affect any right of any person so transferred to terminate the person's contract of employment if the terms and conditions of employment are changed substantially to the detriment of the person; but any such change is not to be taken to have occurred by reason only that the identity of the person's employer changes by virtue of those subsections.</p></content></subsection></section><section eId="section-43" period="#period1"><num><noteRef
