Guidelines for the use of internet connection records under the Investigatory Powers Bill.

Response

The Investigatory Powers Act 2016 is an Act of the Parliament of the United Kingdom that has been passed by both Houses of Parliament.  It received royal assent on the 29 November 2016.

By way of background, NHS Scotland Counter Fraud Services (CFS), a part of NHS National Services Scotland (the common name for the Common Services Agency for the Scottish Health Service) was established by July 2000 with the aim of protecting Scotland's health services from the impact of fraud, corruption, embezzlement and theft.

In respect of the Investigatory Powers Act 2016, CFS are one of the named public authorities which can require the disclosure of processing of internet connection records for one of the investigative purposes defined in the act.  As the act has only recently received royal assent, the relevant code of practice is still in draft.  The code of practice is issued by the Home Office and CFS will fully comply with the requirements of this code.  Once the Home Office code of practice is finalised, CFS will incorporate it in to its standard operating procedures.
