Legal Traineeships 2023/24
Crown Office and Procurator Fiscal Service (COPFS)

COPFS is seeking enthusiastic candidates for our Legal Traineeship programme. 

COPFS is offering a number of Legal Traineeships with anticipated start dates commencing:September 2023 and March 2024.

The COPFS Legal Traineeship offers a wide range of experience and opportunities in the public prosecution service in Scotland.  You will have the chance to work at Crown Office, which is COPFS’ Headquarters.  The traineeship will also involve successful candidates undertaking a range of responsibilities within the Procurator Fiscal’s offices throughout Scotland, including the preparation and presentation of cases in the Summery courts.  If you successfully complete the traineeship you may enrol as a qualified solicitor in Scotland.

Trainees will have the opportunity to work in Procurator Fiscal’s offices throughout Scotland on rotation, flexibility around location is sought. You may also spend a proportion of the traineeship working within another government agency.

Eligibility
  • An LLB in Scots Law

Criteria/Assessment
Candidates will be required to demonstrate judgement and competence throughout the assessment process.  This will include a presentation at the interview stage.

About the Role

This is an exciting entry level opportunity for someone looking to be in an interesting and fast paced role.

You may be starting out in your career or already have an administrative background and looking for a change, but you should have an interest in the Criminal Justice Sector.

You will be expected to work as part of a team to provide a first class service to your colleagues and service users such as, victims & witnesses and defence agents.   

Whilst the role may vary from office to office, main duties will cover a range of administrative support and will generally include the administration of cases including:

  • Collection and delivery of mail from the DX Exchange to the office
  • Opening of mail and distribution to departments.
  • Delivery of court papers/bags to court using the office vehicle
  • Uplift of paperwork from Sheriff Court and Police
  • Delivery of custody papers to court timeously throughout the day as required
  • Franking of mail
  • General porter/housekeeping duties as required and some administrative duties including scanning to assist the team
  • Collating and submission of stationery order
  • Completion of the weekly office vehicle checks.

Essential Criteria

  • The minimum entry qualifications are 5 National 5’s at grades A-C (including English) or equivalent; or demonstrable experience of general office work.
  • Literacy and fluency in English.

  • An understanding of the work of COPFS
  • A desire to work in the Criminal Justice Sector

About the Role

This is an exciting opportunity to join COPFS at the first point of contact at Scotlands sole prosecution service. This post sits within the Operational Support Policy and Engagement Team. The postholder will report to the line managers and business manager at the Enquiry Point. There are currently approximately 35 operators in the Team.

General Responsibilities, Activities and Duties 

Enquiry Point Operators will respond to enquiries by telephone and by email with a wide range of people from victims and witnesses of crime, Police Scotland and other stakeholders.   It is important and often challenging work that can have a real impact on people’s lives.  You will be a good team player, have excellent communication skills, a desire to work in a dynamic and evolving unit and will have the ability to remain calm and effective under pressure.

Role Specific Responsibilities, Activities and Duties

The post holder will be the first point of contact and will answer requests for information from members of the public, police and solicitors.

The Enquiry Point is based within the Dumbarton PFO and is responsible for answering all types of incoming calls and emails to COPFS in a contact centre environment.

The post holder will also perform general admin duties in relation to enquiries received at the Enquiry Point.

The Enquiry Point opens from 8.30 am to 5.30pm.

There is a requirement for the successful candidate to work as required on 3 local public holidays.

Essential Criteria Required

As well as the competencies contained within the application pack the minimum entry qualifications for COPFS employment are:

  • Five National 5’s (including English) or equivalent; or proven experience of general office work.

The Individual  

As a Procurator Fiscal Depute you will play a key role in the criminal justice system. You will take decisions on criminal proceedings, conduct courts and work closely with the police and other criminal justice partners to improve the efficient delivery of justice for local communities.

This is a unique role where you will be acting in the public interest as one of the Lord Advocate’s local representatives, requiring common sense, good judgement and decision making, flexibility, legal and advocacy skills, and a sound knowledge of the criminal law system in Scotland. Whilst you may be asked to undertake a variety of duties within COPFS, the main essence of the role is to mark cases, prepare and present cases effectively in court and deal sensitively and appropriately with victims and witnesses.

You must be passionate about always serving the public interest; confident in making complex decisions, based on independent assessment of all the available evidence; and enthusiastic about public service and meeting the needs of victims and witnesses.

Posts are available in the above locations. The majority of work will take place in successful candidate’s home office however there may be occasions when attendance at other High Court locations will be necessary.  COPFS travel and subsistence rules will apply to the reimbursement of expenses incurred in attending other court locations.

This role is unable to be undertaken from home and requires attendance at court when courts are sitting.

About COPFS

About the Role

The postholder will undertake the role of Sitting Manager/Noter and Preliminary Hearing Manager and will be a key member of the High Court Team.  The Team is comprised of Noters, administrative, and Victim Information Advice staff.  There will be line management responsibility attached to these posts.   

These are fast-paced posts in a busy and high-profile area of the business.  The main purpose of these posts is to provide effective management of all aspects of cases during High Court Sittings and Preliminary Hearings calling at all high court locations, and to effectively undertake noting duties, noting witness evidence in court and all associated administrative duties aligned to the noters role.

Role Specific Responsibilities, Activities and Duties

SITTING MANAGER 

  • Ensuring the smooth running of High Court
  • Liaise with Procurator Fiscals Offices, High Court managing Clerk, Judges Clerk and other outside agencies to orchestrate the calling and progress of cases.
  • Liaise with the Head of the High Court unit to advise of significant matters arising at Court
  • Ensure verdicts and results are intimated to the correct people and provide updates for the Law Officers Briefing as required
  • Prepare draft business list for the next day and prepare folder for the following week
  • Be alert to Preliminary hearing/Trial security issues and disseminate information appropriately
 NOTER DUTIES 
  • To note evidence of witnesses during examination by the Advocate Depute and when being cross-examined by the defence. 
  • Prior to Trial check productions, obtain documentation from Fiscal Officer and ensure copy productions for jury are available
  • Liaise with Sitting Manager and person checking in witnesses re attendance and advising Advocate Depute.
  • Ensure Advocate Depute’s papers and file are returned to the Sitting Manager with full Minutes re plea, verdict, Minute of Postponement, forfeiture/disclaimer etc.
  • Provide administrative assistance and support to Advocate Deputes
  • Operate court room IT equipment during trials when available
  • Training and line management responsibility for noter(s)
PRELIMINARY HEARINGS 
  • Ensure the smooth running of the preliminary hearing court
  • Prepare all documentation for the cases calling
  • Accurately note the outcome of the hearing
  • Prepare report for each case calling
  • Assist the Advocate Depute in court
  • Liaise with PFOs, High Court managing Clerk, Judges Clerk and other outside agencies to orchestrate the calling and progress of cases.
  • Liaise with the Head of the High Court unit to advise of significant matters arising at Court

  • Applicants must also possess a good understanding of the work of COPFS, including the reporting and precognition of cases and subsequent court proceedings.
  • Experience using case management systems and intranet applications.
