Harper Macleod LLP are the main supplier of legal services to the Accountant in Bankruptcy, with Anderson Strathern being the back-up legal agent supplier in cases of conflict.
Following a mini competition between the Suppliers of Lot 6 of the Scottish Government (SG) Framework Agreement for the Provision of Legal Services, Harper Macleod LLP were successful in securing the top ranked Service Provider and Anderson Strathern LLP as the reserve Service Provider. Harper Macleod LP must always be sent instructions in the first instance and to Anderson Strathern in the event of a real or perceived conflict of interest.
The contract for Legal Services commenced on 1 April 2020 for a period of 36 months with a possibility of a 12 month extension
The contract covers the supply of Legal Services for General Advice, Conveyancing and Court action. A more detailed list of services include:-
- Legal Advice or opinion on a wide range of matters arising in a case
- Conveyancing in the sale of a property
- Division and Sale where a property is jointly owned
- Reviewing Legal documents as required
- Family Home – Consent to sell and Eviction action
- Eviction action
- Gratuitous Alienation and Unfair Preference
- Bankruptcy Restriction Orders (BRO’s) court action
- Trustees and other Court Action
- Appeals
- Single Service Letter – where there is no response of non co-operation
- Reappointment of Trustee
Potential legal costs are carefully considered prior to any legal instruction commencing, with an estimate of costs obtained and agreed before proceeding with actions.
